Discrimination in the HOA!?!

It has been brought to my attention that the Oak Knoll Homeowners Association Board of Directors are exhibiting DISCRIMINATION against families (i.e. couples with children)!!!!!

Sorry...old farts on the BOD or those who do not like children; if you did not want to be around those with families...then maybe you should have moved into a community with retired folk then!!!!!!

Despite a so-called "professional management company" and the so-called best HOA law firm in the Portland Tri-Met area...our HOA is making one legal SNAFU after another.

I am only one person in this Community, and until more of you speak up and out against the HOA...not just at the meetings but here and to me...no change is going to take place!!!!!!!!!

This has to be a GROUP effort!!!! We need a MAJORITY vote to legally abolish the HOA!!!!

The HOA has served no good or purpose since its inception in this community. There is no doubt that that path will not change in the future...less you like arbitrarily contributing $14,000.00 or more to an ILLEGAL reserve account that benefits members of the BOD of the HOA at your expense!!!!!

Fellow homeowners...you really need to start talking more about what is more important to our livability in Oak Knoll.

Do you want a tyrannical BOD who believe they can disregard the law and enforce the CC&Rs in a selective and discriminatory manner...or do you want fairness, equality, and justice living within our own homes and the community we live in!?!

  1. I was at the meeting that this was brought up. The subject was pretty much (like every subject we brought up) talked around or just pushed aside. If it is not what the BOD thinks is good it is not heard for long. I was laughed at by all on the BOD and the management person when I stated that cc&r's do not supercede city, state and federal law. People need to realize that these people are running the show at this point rather than us, as it should be! We really need to get it together and get rid of them.

  2. Under the Federal Fair Housing Act, an HOA cannot discriminate in exercising its authority to enforce the CC&Rs based on familial status...the FHA protects families with children under 18.

    Homeowners with children have been harassed and discriminated against in the past in our HOA, and some pretty nasty letters were exchanged (which I still have copies of).

    The management company and ignorant Board Members can laugh all they want and rudely dismiss your intelligent remarks about the hierarchy of the law. The CC&Rs are a private party contract and are at the bottom of that hierarchy. That is a legal fact that they cannot get away from and simply do not want to acknowledge.

    Our BOD will continue to push the envelope, breaking the law and violating the rights of homeowners until we either obtain a majority vote and abolish the HOA altogether, or until they get taken to court and forced by a judge to follow the laws and the CC&Rs as they are written - and without prejudice!
