HOA members...if you want your voices heard, either attend the meeting this coming Tuesday night or send an email NOW voting NO!!!! on the proposed amendments...none of the changes, even #3 and #4, are not worth the extra costs to the homeowners to make these changes. Especially in light of the fact that the CC&Rs are discretionary and the BOD do not even have to enforce them.
However, whatever they do enforce, they have to according to what the CC&Rs actually read/say and not what they interpret them to mean. That is a statutory mandate which the BOD, past and present, have FAILED to do over the many years this HOA has been in place, with or without the wasted $$ on a management company.
I sent my vote - NO - on all 4 amendments.
What needs to happen is an Amendment to the CC&Rs REMOVING the language that states the HOA is responsible for all the trees in the association, and leave that responsibility to each homeowner; as it is already a mandated responsibility as not only one of the responsibilities of just being a homeowner, but the CC&Rs and local ordinances already mandate it.
